    There's no time limit to issuing a default notice. It's standard practice to issue it 3 months or may be 6 months, but some lenders take longer than that. The law only states they must issue the default notice before taking legal action.

    Let's assume OP missed a payment in 2006. Interest is added every month but the lender doesn't issue the default notice until 2009. Yup, you're screwed.

    There has never been a DEFAULT served and ive not moved address within this period either, ive never have engaged with a DCA and checking all 3x CRAs nothing shows regarding the debt.

    Just so annoying too recieve this just before xmas and also not knowing how too challenge it when i have no idea why they have come up with this debt and havent been contacted in 9 years since the voluntary termination...:mad:

    Sorry. If/when you start a thread over there, then would be nice if you could post a link to it so we can follow how you get on and what people over there say. That's all.

    Lot's of claims from these people at the moment, so anyone landing here from say a Google search will be able to follow that to see how you get on.

    By the looks of it you can start a new thread in their special legal claims section by filling in form in this link with details on the case

    Hopefully will be statue barred, I've sent off for the CCA and also the CPR forms to the relevant people just waiting now too hear back so I can defend my case on the MCOL.
