Mortimer & Clarke Solicitors

Hi there

Ive recived a letter today from Mortimer & Clarke Solicitors regarding a debt owing to Black Horse Finance for the sum of £295, i have no idea what this debt is for as back in 2007 i voluntary terminated the finance agreement after paying a third of the balance and give the car back. I have not responded to them as unsure on what too do ???

In the letter is states if i dont pay within 7-14 days there will be a county court judgement served against me for the fee of £295 and court costs also, they also sent me an expenditure sheet to fill and complete.

As mentioned i have no idea what this debt is for ive checked all 3CRAs today and there is no record of Black Horse Finanace on any of them, id also like to state that the car was handed back 8 years plus so surely statute barred comes into play if im correct on whats mentioned above..

    Are there any defaults around that figure on your credit records? Are you sure it is the car?

    I have no defaults whatsoever with any comany and thats the 3x CRAs all checked recently, i state its the car as thats the only dealings ive ever had with black horse and thats who is stated on the letter..

    What more do you need? Based on the information you have provided the debt appears to be statute barred. Write and tell them so.

    I havent heard any reply as yet and nearly 10 days has passed, i wont write to them stating that is the debt staute barred nor aknowledge anything from them going forward, advice was aquired as the court costs expenditure sheet was being asked too which i was very unsure if this was a threat or actual going to court...

    It was a less official expenditure sheet than above, too which i didnt fill in i just placed it to one side as the debt is over 7-8 years old and i thought its statute barred so Mortimer & Clarke are trying the scare tactics maybe...

    Thats why i posted the tread as i was very unsure on what to do !!

    Hi

    It’s hard to say whether they really do have intentions to start court proceedings or not, it could be scare tactics as you say. Either way they would probably ask you for details of your income and expenditure initially.

    If you write to them to inform them the debt is statute barred the onus is on them to prove it’s not or stop collecting from you. You can use the template letter on the end of this Time Limits factsheet.

    Hi there

    I've just received a county court claim form for a fee of £295
    the debt from black horse which the claimant is now Hilsdon Security Ltd. I have not got nothing showing on any of my CRAs for this debt as it goes back too 2006, is there anything I can use too defend that this debt is statue barred and unforceable through the courts ?
