Bos preference account

Just wondered if any ome had success on Bank of scotland preference account card ppi.
I sent off a claim some 7weeks ago, and ive called up again today, and they said they are still investigating the case. I sent the a copy of credit agreement which was also for a loan applied for at same time. I ticked box for loan ppi, which was called credit care. This was upheld as it was single premiium. For the preference account i did not tick the box, as indicated by my credit agrement, however bos apllied it anyway. Any thoughts?

Whst happens if they exceed the 56 day rule, as im on day 50 now.

    There is no 56 day rule. It is an objective but not a deadline.

  • The bank has 8 weeks to investigate and either issue a final response by the end of that time or explain why it is not yet able to do so.

    If a final response is issued, it must either uphold or reject the complaint and give reasons and, if upheld, what it proposess to do to redress the matter.

    If it is unable to issue a final response, it must explain why.

    Either way, it must also explain how you can ask the Financial Ombudsman Service to investigate.

    However, the 8 weeks only starts when the business receives the complaint, not when you send it - and they only have to get the letter into the post by the end of that time. So, for example, if you posted the week before Christmas, they might not receive it until 30 December. Eight weeks after that would take them to 23 February and it could then take a couple of days for the letter to reach you.

    So, realistically, you could be looking at ten weeks.

    Also, if you send it recorded delivery and, as often happens, Royal Mail does not get a signature, then they can legitimately claim not to have received it.

    So, if possible, e-mail or fax a complaint. If you have to snail mail, get proof of posting (free from the Post Office). This will normally be accepted as satisfactory evidence of delivery two working days later.

    I spoke to them on 20th sep, their letter arrived 22may asking me to return form. They confirmed that they received it on 24th sep so which ever way you look at it we are in 47 to 50, depending on the start date. The claim itself is a two part agreement, i have sent them a copy no tick on creditcare for preference account.
    It will be interesting to see what haapens, should get response this week. I never believe a word those call centre people say, they seem clueless!

    I have no reached day 55 on the above claim . I have rang Bank of Scotland several times and just get qn answer that the case is still with the specailsit team. If I dont receive letter tomorrow day 56, am I entitled to contact yhe omburdsman. Do they then contact the bank about the case?

    If you go to the FOS, then the bank will likely slow down and wait for the FOS to contact them. The FOS queue is likely longer than waiting for the bank.

    Its usually worth waiting beyond the 8 week period.

    How long do the bank have to respond to the Fos, is their a time limit.

    It's more of an issue waiting for the FOS to get to your case which can be 18+ months

    Final success, called Bos today, they confirmed claim upheld, well over £1000,. To all members battle on, whenever your ppi was sold, my claims and i had 7, were sucessful from years 1990 to 2009. One was not upheld Mbna, this is now with Fos. Didnt really have too much hassle bar Mbna. Happy claiming.
