Moving out of rented property as relationship has ended

    Your daughter needs to write to the landlord. When the fixed term end in February a Staturory Periodic Tenancy will automatically start the following day and she will still be liable for the rent.

    Are any of the bills in her name? She will need to get them changed to his as otherwise by not paying he could leave them chasing her. Also for rent and any thing which she is liable for it might be wise to pay directly rather than giving the money to him.

    Thanks - she is going to write to the landlord when she leaves informing that she is no longer staying there and get removed from the tenancy agreement - she will cover the rent, of course.
    As long as she is removed from the tenancy agreement then surely the rolling contract will be the responsibility of her partner and up to him to give suitable notice.

    No, that's not how it works. The landlord might not agree to remove her name from the tenancy, he doesn't have to. The sooner she contacts the landlord the sooner she can try and sort something out. Leaving it until she moves out and sending off a letter might not cut it. She needs to take action now.

    Shelter has information on how to end a joint tenancy agreement. A landlord may agree to an early termination of the contract and then its up to the other tenant to negotiate it in their own name.

    Did she get the flat through an agency? Is there anyway she can find the tenancy agreement which the ex has presumably hidden somewhere in the property?

    Whose name are the bills in?
  • Surely, as long as she gives sufficient notice and informs she will be leaving but paying rent then she cannot be held to ransom to pay beyond the date the tenancy ends. Her ex will be leaving in the February also as this is when the lease us upto
  • They are not ending the tenancy early. It is due up in February and her ex will stay on until then

    And if he doesn't move out she will remain liable for the rent.

    For the joint tenancy to end they will either both have to leave or the landlord (and the remain tenant) will have to agree to a new tenancy soley in the remaining tenant's name.
