So, if Beavis loses...

The much awaited decision by the supreme court is due out tomorrow (Wednesday 4th November)
What could/may happen if Barry Beavis loses his appeal?
Apart from a lot of crowing not much, it could easily be argued that the case could only apply to a small set of car parks where the PPc pays a substantial fishing licence, while this may cause a few headaches with some of the airport type operations, in the grand scheme of things not a lot elsewhere would technically change.

If the PPcs go on a feeding frenzy then that will only lead to one place, eventual regulation and control, along the lines of what happened in the clamping world, there could even be legislation passed to put a stop to the antics of the PPCs. either which way any press attention would be unwelcome for the likes of the BPA and especially the IPC.

Another side effect could be commercially justified penalties appearing elsewhere, such as in restaurants, vehicle hire, and so on.
One question would be is where would that leave the Dunlop Pneumatic tyre co Vs New world motors decision?

Even if Beavis does lose its not game over, and the PPC industry will have a huge and irresistable opportunity to shoot itself in the foot - interesting times ahead

    If Beavis loses regulation is imminent. If Beavis wins regulation is imminent. So it doesn't really matter what happens.

  • No matter what the outcome, I would have to agree with bazsters comment that regulation is inevitable.

    No doubt after the more informed have had time to digest the outcome after the intitial crowing from both parties claiming victory especially from the PPC,s that no doubt with a lengthy verdict there will be as many loopholes opened as they have closed off.

    Once the inevitable PPC trolls turn up later today I hope rather than engage in name calling, mudslinging etc they are either ignored but if by some small chance they are open to debate the findings this should be encouraged

    Change is the only constant and not least in PPC World.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    It is a strange business, supposedly about parking management, but if they managed to do it, all they would manage is to put themselves out of business.

    Personally I think Beavis unfortunately was the wrong case to try this out on, as most of the argument was based on what PE pay the landowner.

    However I don't think it matters win or lose, and think all it will do is bring regulation, and hopefully fairness.

    I agree that regulation will eventually be the outcome but am not so sure that it is imminent. It's clear from the complex arguments raised in PE vs Beavis & other cases that perverting contract law & claiming damages isn't the appropriate mechanism for managing car parks. The abuse of the courts on an industrial scale cannot continue. ANPR is not permitted in council car parks for very good reasons. The only proper management of car parks is with exit barriers & boots on the ground.
