Moneysavers Bank Letter Query

Hi everyone,

The MMS bank letter template ( open new claim) states at the beginning:

' I am writing to request that you repay all the charges in relation to direct debits, unauthorised overdrafts and standing orders that have been applied to my account in the past six years.'

I meet many of the 'eligible' statements for reclaiming bank charges, but I am not in an unauthorised overdraft, but I am unable to break out of my overdraft and mounting charges that are keeping me there. I use credit cards to pay bills etc.

My question is: Can I use this letter template to reclaim charges that have been and are being incurred for remaining constantly in overdraft rather than dipping into unauthorised overdraft?

    The template doesnt sound very good. Are you sure its a current one?

    There is nothing wrong with remaining in constant overdraft. Its not ideal but it does not indicate any problems in itself. As the banks only need to consider incorrect application of charges of CURRENT financial hardship cases, which of these applies to you?

    On the assumption you are trying under financial hardship, how strong is your case? Do you have arrears/defaults? Does your spending show no consumer items (large mobile phone bills, dining out/takeaways, pay TV etc)?
