Can I claim it myself? Personal injury

as usual all advice welcome :)

In short-

3rd party admitted fault

I was hit whilst stationary by an insured 3rd party - they reversed into my car from their drive.

I did not see a doctor for a few weeks as I flew away on holiday 2 days after and then with the back to work rush time slipped away

I have suffered occasional black-outs since the event and anxiety attacks - doctor noted

In addition to this I have had several days off work due to dealing with car hire, car collection, drop off and de-hires and a few hours off work here and there for doctors appointments, telephone calls in relation to the accident etc.


I really would like to avoid engaging a personal injury lawyer as;-

1- i feel really sorry for the elderly lady who hit me, she appeared very distressed
2 - i have many other stresses in my life right now and do not want to add to them

so i was wondering whether i could approach the insurers directly and propose a claim settlement? and if so what could i include in the claim?

    As far as saving the elderly lady any distress then she won't get any stress over a claim as it will be dealt with by her insurer.


    Your own stresses will be made worse trying to deal with this yourself - your symptoms/condition (blackouts etc) are more complex than a bit of neck pain.


    Put all this in the hands of a solicitor and leave it to them to sort for you - no stress for you, and no stress for the old lady!

    I will just make the point on this thread too but you have been suffering from depression as early as May 2011 and you've had worse things happen to you in the past (violent robbery 3 years ago and potentially getting checked for PTSD in the next few days/weeks, not to mention your breakup around 2010-2011 which has probably not helped).

    If you use the idea that this stationary crash has caused the above symptoms, be prepared to potentially show that THE CRASH caused these issues and not simply the previously mentioned circumstances. Your claim against this woman for anxiety and black-outs may amount to insurance fraud if it can be shown that you had these problems BEFORE the accident.

    In fact, based on your post history on this forum IT IS insurance fraud in my eyes. There is no way that the stationary car crash alone caused these symptoms. You'll have to rely on the insurance company NOT investigating, which they probably won't do in fairness (lets hope you haven't been to the GP in the last 4 years suffering from depression/anxiety/PTSD because that will be a good place for them to start an investigation). You'd have probably been better going for the 'whiplash' claim in this situation :p

    EDIT: The whiplash claim you possibly went for in 2008, when Quentin (of all users) gave you advice on a similar situation (people never learn :D), is a good example. Either that or move to somewhere like the *cough* Mediterranean where there aren't many old grannies who can crash into you ;) hehe

    OP's situation is like throwing wood onto a raging fire. The fire burns a bit more brightly, but it didn't start because of the wood.
