  • The more recent accident seems to have been an exacerbation of the pre-existing problem and is still compensatable.

    It would make sense to speak with a solicitor as not only will it be possible to get you compensated for damages and potentially lost earnings, but the arrangement of counselling and therapy may also help to get you back to functioning.

    someone told me it would not be worth my while because the amount of hassle i would have to go through again and only get a very small amount of money.then because I had an accident in the past it would end up going to court.

    If you mean the eggshell skull rule then yes, it's well established - the fact that the victim is predisposed or unusually susceptible to a type of injury doesn't prevent him from claiming compensation for that injury.
