What happens if I can't pay?

  • I'm really getting confused here. Some are saying if I don't do anything then nothing will happen but you'll be unable to get credit for 6 years and others are saying that you MUST do something and attend court for CCJ's and the rest. My head is spinning
  • Give payplan or CCCS a call:

    They will help you get this sorted out but you must be honest with them.

  • Sub - generally, we agree. I read the OP as "tell me about all my options and what might come next". You were cleverer and took the "how to avoid all that" line.

    I tried to answer the OP factually and state what could happen. I genuinely intended to inform people about the process and if anyone is frightened by what I posted, I apologise. To be clear - you have rights. If you can tough out attempts to get you to pay, then Sub is right. You cannot be forced to pay. But you should be aware of what lenders might do. In my experience, some of them do go "the whole hog".

  • Sub - just one point
    The county court has no power to turn unsecured debt in to secured debt. They DO NOT (and cannot) give credit card companies etc charges against your property.

    Are you sure about this? If the lender obtains a CCJ and you ignore it, can they not apply to the Court for a Charging Order?

  • Well, they can't make you pay more than you can afford to, and they can't send you to prison unless you've run the debt up or acted fraudulently.

    Why?
    I got credit cards that i can't pay i got a mortgage and i've sub-letted the property,the phone num has been changed,but i own a property abroad and we have moved there, if i stop paying the credit cards in the UK what can they do to my properties???

    just to add there aren't actually that many that do go to court if you arrange a payment plan and you keep to the plan and don't miss.

    keep the debt agency informed at all times by writing, not by phone

    oh and if you can change your phone number and don't give it out, they can be quite horrible on the phone so deal by snail mail only.

    If you can make a payment plan then do it now. If you ignore them they an go to court and obtain a ccj against you and if you don't pay that then they can apply to the courts for a charging order on your property, and that you don't want as they are paid out straight after the mortgage company plus they are earning interest at 8% per year the charging order is there.
