Landlord has upped our notice period to two months from one month in the contract??

Can you help?

We signed a contract with a letting agent in January which said we only had to give one months notice. However when the landlord visited she said as she had to give me to months I should do the same and send me an email confirming this. We are now moving out as we are buying a house and we conpleated yesterday. Really don't think she has a leg to stand on as she never changed the contract on on paper I have never agreed.
Advice please as I really don't want to pay a mortgage and rent just before Christmas!

    unless you signed anything to agree to two months notice forget it .

    Assuming you are in England or Wales your notice period isn't necessarily as straightforward as giving 1 month. If you have a fixed term tenancy then you can just leave on or before the last day of the fixed term without giving any notice. If you have a Statutory Periodic Tenancy your note periods have to align with your tenancy periods. See Ending/Renewing an AST for further information.

    In any case your landlord cannot unilaterally decide to increase the amount of notice you have to give. Hard cheese if she thinks it's not fair she has to give more notice than you. She had the opportunity to make the fixed term tenancy become a Contractual Periodic Tenancy at the end of the fixed term and didn't. Boo hoo.

    Ignore her email.

    Rely on either

    * the contract you signed and/or

    * the notice laid down by statute (law)
    as appropriate.
