I am not sure it should be 'at their discretion' though, as clearly the item cannot have been fit for purpose, of merchantable quality or even 'as described' at the time of its purchase.
Whether you are sure or not doesn't make any difference.

The Sale of Goods Act allowed you a short period* in which to confirm that the goods conform to contract. During this time you can reject the goods for a full refund if they don't so conform.

After that 'short period', during the first six months the goods can be assumed to be inherently faulty if a problem occurs. This means the seller must supply a remedy unless he can show that the fault is due to user error, misuse, fair wear and tear, etc.

The remedy can be either a repair, replacement or a refund. You can express a preference, but you cannot insist that the seller provides a remedy which is disproportionate. In other words, if the seller believes that a repair is the most cost effective remedy, then that is what you'll get. This perhaps where your persuasive skills come into play - rather that a 'I know my rights' mantra.

*since 1st October, that 'short period' has been better defined. It is now 30 days - but you are outside that 30 days anyway.
  • Thank you all for your very solid advice and support.

I am now delighted to say that JL have redeemed themselves by offering to collect the offending article and process a full refund.

I am as pleased for having my faith restored in JL as the money itself.....all I have to do now is choose a new model before my dustpan and brush wears out!!

    Appreciated !

    :)
