Complaints to ICO & FOS

Hi,

I have a couple of defaults on my account that have been recorded incorrectly (Lloyds and MBNA) - they are both currently looking into the issue after I phoned them to escalate after they didn't respond to my letter.

I have done a lot of research on this forum as to what to do if they refuse to amend the date and I found numerous threads where the advice seems to be : report/complain to ICO & FOS

However all the threads I found end there and I don't see any follow up as to how successful the complaint was and how long it took.

So.....

Has anyone done this ?
Was your complaint upheld ?
Was the creditor forced to amend the date ?
How long did the whole process take ?


Also, do I need to report to ICO & FOS at same time or is there a strict order ?

    I don’t know about the timescales and outcome of complaints but you can go to the FOS and ICO at the same time.

    I had luck with fos over Sainsbury default date being 32 months after I started dmp also got my 12 pound default charge for them 32 months refunded and interest for 24 months mbna was rejected by fos , after over 3 years never had a reply fron the ico good luck took nearly 2 years for me

    I thought the ICO stopped taking individual complaints regarding credit files?

    I may be wrong of course.

    Good luck with MBNA.

    They failed to issue a default and marked my account with AP while on a DMP for over 4 years and the FOS and ICO both upheld MBNAs position that they did not have to put a default on the account (thus I was in a worse position than someone who had totally stopped making any payments).

    Fortunately for me, the account was settled Jan 2010 so I don't have long to wait for it to drop off.

    I hadn’t heard that but I’m interested to know if that’s the case. Has it been mentioned on the forum?

    The ICO website just says ‘report your concerns to us’ regarding issues with credit files, and seems to imply it’s for individuals.
