E-On overcharge
Cannot get my money back. E-On took money from me via a pre-pay meter and direct payment online which made an overpayment but refuse to resolve. I tried Energy Ombudsman but they didn't have all the files and closed their own investigation, meantime did a SAR and got the information myself that proved I was right, wrote back to E-On several times asking for the overpayments back and they refuse to deal with it saying that it was already reviewed. Tried taking them to court before I did the SAR but couldn't prove the errors at that time so case was dismissed. Now I have all the meter data, payments, transfers etc I guess I will have to go back into court again but cannot afford that right now. So cross with E-On for doing this to me as a lone parent I cannot afford to be done over by them!

I wonder how many of these errors in overcharging are the fault of the companies in between the consumer and the Utility company, as the data is collected by 'others' and passed on to companies like E-On, Npower etc., and have no direct permission from the customer to process their data in the first place. After a struggle I obtained the data sheets from my provider across two meters and there are large gaps where nothing is shown. No doubt this is then estimated and the final bill showing estimated too - crazy.0

You could try talking to them.
But the fact you went to court, and the supplier successfully defended your claim against them, I fear they will no longer entertain any further complaint over this matter.
You amy also have trouble convincing a court to hear another claim, essentially the same as one you previously had dismissed.
I suggest you seek legal advice. It may be possible if further evidence has now come to light to appeal the decision, perhaps in a higher court.
But as you've got no money, having spent it all on a misguided claim originally, I fear you are stuck until you manage to save yourself some more pennies.0 -
Hi, the way I understand it is that E-On did not successfully defend the claim as it was not heard, it was dismissed which I think is quite different in law. The statements produced by the defendant contained information that was not made available to me until after the hearing. The new evidence came when I did a SAR combined with the paperwork handed to me by their representative after the hearing so I believe that this new evidence can be now be put forward to the court. Might be wrong but having sent it all in a very clear format to E-On I still think that their position, which is to say we are not looking at it, is erroneous and appalling. This behaviour can only go against them at a new hearing that I will strive for. Thanks for your response.0

Good morning campari
I'm going to be completely honest and say I don't think I can give you very much advice really, this has gone way above me.
I agree with footyguy and talk to us, we have a legal team here and I think they're best placed to deal with this for you.
I'm sorry I'm not able to be much help.

How much money do you believe you are owed and how much money have you spent on the SAR and dismissed court case?0 -
So the way I see it, you had a prepay meter, then you changed to a credit meter?
So if you used £1000 of energy on your prepayment meter, and had topped up £1200, E.ON would owe you £200. Surely this would be sat on your account as a credit and then would be taken into account when working out your direct debit payments?
It seems unlikely they'd have just spirited that money away into a black hole. I suspect if you push them they will be able to work out the credit balance at the point of meter exchange and refund it to you, but that you will then see an increase in your direct debit to cover the shortfall that will be created.
I also think you've probably spent a bit more time, effort and money on this than you should have.0
