Minster Baywatch/DRP my sister outed me as the driver!

Hi,

Sorry to post but I'm really unsure what to do, I've read the newbies guide but I'm afraid most of it is going over my head!

I first received the parking fine for spending 22 minutes in the Reel Cinema car park where I was waiting to pick up one of my mates from seeing a film, then a few weeks later I get a letter telling me I need to pay £100 parking charge, so I walked to the cinema and asked them basically what the hell is going on as I didn't even leave my car as my friend wanted to stay and get with this girl, so I leave.

The woman in the cinema told me that there is a 20 minute window for people picking up others, I was there for 2 minutes more than the "grace period" and they feel that's worth £100.

My sister then decided she would email (on my behalf without me knowing) that I wouldn't pay (she used "I" and "myself" to identify me as the driver and used my full name to sign off) and then I get the response that they wouldn't accept my appeal.

They sent another letter demanding payment and saying that I know have incurred extra costs (the ticket is £155 now, somehow) and I ignored as I read online to do, now I have the Debt Recovery Plus team sending me a letter saying I have until the 30th of this month to pay or they will advice legal action!

What should I do? Should I just pay them or continue to ignore?

Sorry for the wall of text I just don't know what to do!

post #4 of the NEWBIES sticky thread deals with DRP (debt collector letters)

in simple terms , you IGNORE drp and any other debt collector letters

you are now at the point of "put up , or shut up)

ie , take me to court

the PPC (not DRP) have up to 6 years to issue court proceedings in the small claims court, so you are in this for the long haul

come back if Minster issue court papers within the next 6 years

did you receive a popla code with their rejection ?

if yes, when was the expiry date ?

if yes , why did you not appeal to popla ?
  • Thank you for the rapid response, what is the likelihood of them issuing court proceedings? Also should I send the DRP a letter stating I will not be paying or just leave it alone full stop?

    Thanks!

you can send a DEBT DENIED letter to DRP, referring the alleged debt back to their client (minster) - or ignore DRP

I dont think minster have tried court yet, but dont make the mistake of assuming the future will be the same as the past

depending on the Beavis case outcome next month, things may change and parking companies may issue more court claims

PE never used to issue court claims, but now issue over thirty THOUSAND per annum , with between 30k and 50k per annum now being issued by various scumpanies

    so never say never

that newbies thread tells people not to start more debt collector threads, just to read the existing threads , like say this one

    https://forums.moneysavingexpert.com/discussion/5161978

    read posts #12 and #13

the point is , do the research and read the hundreds of other threads about debt collectors and parking tickets, its been explained umpteen times over the last few years

ps:- you did not answer my questions either , about popla codes , expiry dates and why you didnt appeal to popla

if asking for advice in future, try answering the relevant questions too

Another option would be to get back to the cinema an demand that they cancel this unlawful charge - that is if the car park is the cinemas car park and not a shared facility ona retail park

  • Thank you for the replies, sorry it's another of the same thing I'm not very good with forums! I'll leave it until they decide to go to court as I feel my case is strong.

And as for the cinema they said when I went to see them that they don't want Minster Baywatch there, and they would back me up if I needed, not sure how true that is but it's something! thank you.
  • Sorry didn't see those questions, my sister used her email and the response she got had a POPLA code but I had no idea what that was and assumed it was something owned by Minster Baywatch so i didn't proceed with anything, stupid yes I know that now.

The expiry date was 29th of July looking back to their letter

Expiry date of the POPLA code was 29th July? Try it on POPLA...go on, try it.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Hi sorry late reply been away, I tried it on POPLA but it say wrong code or something to that tune!
  • put your code in here http://www.parkingcowboys.co.uk/popla-code-checker/ , guestimate the date
  • Says the code was registered in 2012, I'm assuming they've plucked a random code and hoped for the best?
