Retrospective permission from freeholder?

I am selling my leasehold flat. 2 years ago I put in new windows replacing the rotten timber framed ones with upvc ones in the same colour as the originals. Some of my neighbours have had theirs done and I had no idea I should have asked permission. I don't know whether the neighbours got permission as I don't know them to ask and it has never occurred to me to find out previously.

Please don't tell me I've been stupid, I should have read the lease etc - I am only too aware of that!

The buyers solicitor has asked me to go back to the landlord and ask for retrospective permission. I've done that and they've said they'll reply in writing. I'm terrified of what they're going to say. Anyone had experience of this and could suggest likely outcome?

    They might

    * just say yes
    * just say no
    * send you a bill for a surveyor to inspect the windows and then say yes
    * send you a bill for a surveyor to inspect the windows and then say no
    * instruct you to remove the windows and replace with wooden ones

    Let's hope you are not also in a conservation area and/or listed building.

    And let's hope you used a FENSA (or similar) registered installer who gave you a FENSA certificate, or you applied for building regulations certification.
  • Yes, we used a FENSA registered installer and no we're not in a conservation area.

    I know ignorance is no excuse in the eyes of the law but I seriously had no idea.
