Extremely long PPI claim

Hi all,

I wondered if anyone has had a long drawn out process as me.

I started a PPI claim with a claims company. I went into it knowing that they take 20% of anything I get - I was happy with that as I don't have the time to do it myself. I also had to pay money up front to cover the claim process, for which I was informed that I was protected by law that in the event of no PPI success, the consumer was not allowed to be out of pocket.

Having paid this fee and started the process, back in October 2014, I was told that it should be around Xmas 2014 to complete the claim.

Now, a year on, I am still waiting for this to be complete. All avenues so far have led to 'No PPI' on the monthly reports from the PPI company. I have one claim outstanding, which is against my mortgage company Cheltenham & Gloucester.

This has been dragging on since April/May time and despite me calling and emailing, I get no joy in concluding this process. To be honest, I just want it completed and the money returned (with interest I would expect). But each time I am met with the following:

We are sorry to hear to that your claim is taking some time to complete, it is extremely difficult to provide an accurate time frame for these claims. Currently you still an outstanding claim that is being processed through ourselves. Unfortunately, until all your claims are completed we are unable to close the account and issue any refund.We are doing everything we can do get this final claim with Cheltenham & Gloucester.

I am sick of this now and want it finished so I can close this credit card.

Has anyone experienced this, or could suggest a resolution ?

    I'm confused, on what grounds are you pursuing a claim if PPI was not paid in the first place?

    I was not aware of my various credit cards and loans etc. whether I had PPI or not. The claim company informed me that there were lots of hidden PPI charges that most people were unaware of.

    The only reason I trusted this company was that friends of ours were in the same situation and managed to get a tidy sum.

    So you put in a claim for no valid reason?

    What do the terms say about a refund? Do you think that, having chanced your luck, you may have been scammed by a fellow chancer?

    The company is regulated. Their terms and conditions state (in particular 6.2):

    6. What happens if your claim is not successful?
    6.1. If all your claims are not successful or if we consider that your claim is unlikely to be successful, you do not have to pay us any fees in relation to that claim
    unless:
    6.1.1. we have to end the agreement because you have broken that agreement or we were not able to make the claim due to the cancellation of the
    agreement after the fourteenth day, by you (other than due to us having broken the agreement or your exercising your rights to cancel in accordance with
    paragraph 11) In most circumstances we will have completed our services after this time and as such if you cancel after this period the administration fee
    will only not be refundable.
    6.2 If all your claims are not successful we will refund any administration fees paid by you in full, within 30 days

    Oh dear. A method of payment frequently used by scams and dodgy companies. It is frequently used in advance fee fraud which has seen some CMCs do this then later fail taking all the up front money with them.

    That is a breach of guidelines as they should not give unrealistic timescales.

    Which is an easy one to see if you had it or not as it was paid by a separate direct debit and not bundled with the mortgage.

    So, another breach by the CMC by making a fraudulent complaint in your name despite not paying PPI.

    There appears to be some Karma working here. You paid a company to put in fraudulent complaints and they stitched you up whilst doing it.

    it wouldnt take Lloyds very long to find out if you paid PPI or not. If you looked at your bank statements you would see if you did. So, the timescale you have had does not reflect the Lloyds service standards. I suspect the CMC is dragging it out to delay refund. if you phoned up Lloyds and asked them if your C&G mortgage had PPI, they would be able to tell quite quickly. You could then relay the outcome of that call to the CMC.
