Hospital Red Route Parking Ticket (POPLA letter check)

Hi All,

just after a bit of advice. my girlfriend managed to get herself a parking ticket (£40 or £70 after 28 days) at work (NHS hospital) but parking on a double red line. she had been at an interview all morning to return to no parking spaces. she trawled the car parks for 20 mins before having to park on the double red line to avoid disciplinary action for being late for her shift (Nurse).

so that's the sob story which has little effect on an appeal, i know.

The ticket was issued by legion group ltd.

i'm just after some advice as to how to approach the appeal. i have won an appeal with this company before, but for my girlfriends permit falling off the window. this time, as an offence it is fairly cut and dry she was in the wrong.

so, i'll wait for the notice to keeper, then should i just go down the standard line of she has a clearly displayed permit, so the £40 loss is not applicable as no loss has been sustained by any party + the normal no proprietary interest in the land + unlawful penalty charge etc.

any advice would be much appreciated.

red lines on private land are pretty meaningless (were there signs telling her what the red lines meant?).

she is going to have a look today as it isnt a normal area of the hospital grounds she parks in. im sure it will say it on the main signs, but what would be considered appropriate signage in that area. 1 every 50 meters?
  • umm , red lines are just graffiti , however if they want to pull that stunt , you ask a serious question

" but what would be considered appropriate signage in that area. 1 every 50 meters? "

I would expect the answer to be , inline with markings placed on a council type rd , of which the general public are accustomed too

Please do read the Newbies sticky thread because you don't wait for the NTK.

The registered keeper is best sending the Sticky thread 'template' appeal to Legion online if possible or by email if offered (a letter = last resort) around day 26 after the PCN, not adding anything in case it gives away who was driving.

Then at POPLA stage, one of the main appeal points would be that the PPC has omitted to send any NTK by day 56 so the keeper is not liable (obviously not answering POPLA's leading questions aimed at drivers and obviously waiting until safely past day 56!).

thanks Coupon-mad. i'll get onto sorting a letter asap. i just want to know the best approach to have.

having a look on google street view there are signs in the area about the red route. so possibly stick to the fact that the fine does not reflect actual losses?

Not a letter, as I said, no! Use the template from the Newbies thread in full - and not by post unless you have no choice (get a free cert of posting but don't choose that over an email or electronic appeal if offered). And timing is vital to string it out past day 56 by the time it's your POPLA deadline.

A nurse that doesn't understand the importance of red lines - worrying.

I guess they're only important if you're in the ambulance that can't get you into A&E because some idiot has parked in the way.

That would be true if it wasn't Legion Group trying to extort money over some lines they probably painted.

your right, she should have endlessly gone around the carparks instead of getting into work and actually helping people.

A poster that doesn't understand the significance of a Traffic Regulation Order.

I guess they're only important when you want to enforce red lines on a road, or speculate that someone posting on an internet forum delayed an ambulance, and is an idiot.

    Well done.
