Flipped ticket

During the summer we received a PCN because the wind blew it the wrong side up when we were getting stuff out of the boot at the beach. AS Parking are the company. Sent a copy of the ticket and cover letter to them to demonstrate that the ticket was valid at time of PCN issue (didn't identify driver). Maybe 1st mistake was sending letter and not going through their website.

Received second letter and sent the same letter recorded delivery this time with addition or request for POPLA code (although out with date for appeal). Received DRP letter and responded with letter to them indicating the rejection of the debt and referring them back to AS Parking. Alongside that sent a letter to AS Parking indicating that we would continue to challenge the PCN on the grounds that it did not represent a genuine pre-estimate of loss (a ticket was purchased) and the lack of adhesive on the ticket contributed to it not being displayed properly. Received the letter returned along with a refusal to enter into further correspondence followed by a further letter from DRP offering a reduced amount to settle as a final offer.

It contained the following sentence 'a court judgement against you could seriously affect your ability to obtain credit in the future.' My understanding is that credit rating would only be affected if I refuse to pay a court ordered payment. In which case would that sentence be sufficient to refer back to them as being intimidatorily laying out a false premise?

Also, what (if any) precedent is there for claiming a return to POPLA out with the given timescale?

Any other thoughts, advice or help would be much appreciated.

    Didn't AS Parking move away from the BPA, so no POPLA is possible from them now, only the rubbish IAS joke?

    What was the date of the parking event?

    I can't find them in either the BPA or IPC, but I've only skim read the two lists because I'm stateside and am about to go and get breakfast. :D

    Was well known for avoiding allowing any appeals but have now switched to the IPC from 01/05/2015. Appealing to the IPC is pointless anyway.

  • Thanks for all your comments, way more than I expected. I have been tracking with the newbies thread but came to it late (I didn't realise at first what I was dealing with). Their letterhead says BPA and IPC.

    Is ignoring them the advice given that I haven't ignored them to this point?
  • the reason that they say BPA and IPC , is that the BPA has 2 sections , one v section is the corporate section , even your local counsil will be a member! the other section is regarding the ATA , (approved trade assoc) this is the method of getting info from the DVLA


    the logos are different , the corporate section use a blue/white logo with the letters BPA , the ATA uses a "roundel (blue/white and an orange) that says BPA and the words ATA


    the IPC came sometime later , this is a set of ex clampers with a dubious company of solisitors running them

    With one p.s., should you ever be scammed by a pp scumpany again, op -
    never ever send anything RD[ #1, para2, l.1]

    It allows them to refuse to sign for it, denying you proof of having sent anything.

    Any letter sent 1st class is deemed delivered within 48hrs. Always obtain and retain a Certificate of Posting, free at any PO.

    Or, if you submit anything online, take a printable screenshot, timed and dated.

  • AS are a bit of a company run by a bloke called Kevin McManus based in Newquay.

    For some reason or other, most people tend to ignore him. Have a look at at farmerboy's posts on pepipoo. Or just google it.

    His signs seem to be a little ambiguous. They say he belongs to the BPA, but the BPA say not.
