Faulty mobile phone

My Father purchased (on a contract) a Samsung s3 mini mobile phone in Late July/Early August.
The phone beeps intermittently, will stop for a few days and will then start again, sometimes in the middle of the night.
He has taken it into Carphone Warehouse twice and they have reset the software, but it has not solved the problem. The phone was doing it on one occasion when he was in there so they have heard the fault.
Can someone please advise me as to what course of action he can reasonably expect them to take, does he have to accept the sending it away for repair (was suggested this may be an option last time they reset the software) or can he reasonably ask for a new phone?
He is in his late 70's and I am getting a bit miffed that he keeps having to take train journeys back to the shop only to be sent away again without it being fixed.

Within the first 6 months the store has to prove that it is not a manufacturing defect if they can't do this they have to refund/repair or replace without causing significant inconvenience.
But it is at their discretion to choose which (likely repair).0 -
