Regulation for under 16 help please.

Hello. I'm currently looking for some advise as i find my council are trying it on about bill what i've never heard of.

I was 15 when i get put into an emergency council house when i was pregnant and had my first child. As far as i remember i wasn't a sole tenant as i was under aged. So my Dad was for the first year. Sadly my dad moved out so i moved a friend over 18 in as council said i couldn't live there under aged. I live with my friend for 6 months and then i left as we didn't get on.

It has now been 16 years but i want to move from my property but council have refused due to apparently i owe them this money of 860. I disagree but council are refusing to provide any details. The only details they have provided is which i disagree with that i was sole tenant of the property while i was under aged.

The debt suppose to be for repairs after i left property but i find that this is misleading and no evidence as been provided. Could any one list any regulation for Under age minor living alone and any others that could advise me as im stuck but i think the council is trying it on.

    They are not going to keep any evidence for 16 years.
    You say it is "misleading", but not "untrue" that you owe the money.

    Also, the council are not disallowing you from moving from your property due to the debt. You are not a prisoner.

    Ask the council (write to them, yes, WRITE! - keep copy) for a copy of any tenancy agreement you signed...

    If you were under 18 it is likely any tenancy agreement signed (if there every was one ..) was invalid.

    Have you been the sole adult occupant and have you been paying rent to the council (or claiming housing benefit in your name which is paid to council)???

    According to Shelter you can have a tenancy and be laible for necssities from 16 years

  • If the debt has not been mentioned in the intervening years it may be statute barred - speak to CAB or Shelter

    Yes I'm still council, I would love to move into a house in a different area due to my mom illness. The council are currently stating that i won't be moved until i payed up

    The answer is yes, i'm currently renting at the moment as a sole tenant.
  • I will write here how far i've got.



    Right rang council today as I wanted dates. Council told me 2000 Dec 20th till 2002 June 2nd. I was living as a sole tenant with no one registered. Therefore i got my father to ring up about his rent to try and claim it back as he paid my rent. The council first told him that he was a joint tenancy until he asked for written proof. Shortly they change there minds and said he wasn't so he asked for a refund which they couldn't answer.

    I mention to council stating i was a minor and i not liable in any chase and i asked there regulation to be sent to be. The woman gladly told me min age is 18 for sole tenancy which means they are breaking there rules. I asked for proof of all work done on the property i was in debt for. The housing manager told me she next to contact another copy. This would take 28 days.

    Citizen advise are stating that council are trying it on and trying to fob me off and dragging it on. They have told me to write and written letter about debt and give them 14 days to reply. I'm no in progress in writing the letter to the council / council area manager. I have booked to see a Councillor on Week this Friday and hoping he will help me write this debt off.

    Yes it just means they can't enforce payment of the debt from you but they don't ever have to deal with you ever again if that's their policy.
