Lego Dimensions Xbox problems..

Having brought my son the Warner Brothers Lego Dimensions game for the Xbox 360 (£75) and a gaming pack back to the Future (£25) and he has brought an additional fun pack (lego ninjago £15) we have come to a problem with the game.
I can not download the additional pack to enter the extra worlds. I have spoken to WB technical desk and they are aware of a problem and have been since the game launched. I have tried there recommended steps but it is still not working. They have taken my details and will contact me once a resolution has been found.
The problem I have is having spent £120 for a game which is meant to be the future of gaming...we have two figures we can not build as the instructions are in the game.
I am currently awaiting a manager call back to discuss the issue, but my question here is legally where do I stand, the games company are still selling a game and accessories which they know has a large problem.....

They're also selling it knowing that in all honesty by the time the vast majority of their customers get the product (Christmas) the problems are likely to have been resolved.
When you say you cannot download the extra packs - what's the issue, is it a case of it's impossible to do so because of server issues or because you have a lack of hard drive space? (Or potentially because you have a 4gb machine) I get the frustration, but there's also the key fact that when you're talking about a game it's often not so easy as just rushing something out there to fix the issue - it may take a reasonable amount of time. I know that some will argue that the law doesn't specify that you have to give them that, but well, it wouldn't be the first time the law has used a sledgehammer to crack a walnut.Retired member - fed up with the general tone of the place.0 -

Game states that a further download/upgrade is required but then is not there to download. Floor in the game which they are looking into. I appreciate it's not something you can fix overnight, but my point to Warner Brothers yesterday was they have known about this since launch and there is no information about it. But at the time of purchase they knew the game had a problem, when I spoke to game they were unaware of it.
The base game works (there first response) but not all of it, because at times it suggests using other characters not in the starter pack, which you cannot build until you access the extra worlds.....
Awaiting an update from the States (game developers) but if they've worked on it since launch then I assume its going to take another month to get it sorted, minimum. This isn't the first time that a game has been launched despite a bug being present.... it won't be the last time either!
I'd say that a tub of real lego, or fresh air, is better for a "frustrated 10 year old son" but I'm not sure that will go down well...
That aside, not sure where you stand legally. Your game functions for the most part and so it is hard (but not impossible) to argue a 'faulty' case against Game. I doubt that you have much leeway with Warner Bros, other than to find out when the fix is likely due.

I agree, we do limit his time on games, he also has lego which is why the game appeals. You build and rebuild the figures as you go along.
The base game is affected by a lack of other characters.
Update from WB - They are aware of this problem, that did not appear in initial game testing. It seems it only affects the XBox 360 and then it's only certain modules. They have said it affect less than 100 customers and so therefor is hard to replicate to then fix.
They have kindly sent him an apology and the Lego Jurassic World game.
I like these games as you have to solve problems, work logically and explore the game. It's not a simple shoot them up. But like i said we restrict his time on the game.Proud to have dealt with our debtsStarting debt 2005 £65.7K.

FURTHER UPDATE-
Thanks for all the advice and support. Last week I received an email, stating they had fixed the problem. Once in the game the portals had moved around, so a good start I thought, but still no downloads.
I replied to them and the answer was you have to be an adult to start the downloads.....so basically i used my profile to download them and then switch to my sons so that he can play.
So problem solved! Equally it allowed me to download all the extra packs so when he gets a new pack we dont have to go through the downloads again, it already there.
