Falsely sold a computer on gumtree

Hello, basically the title says it all.
I was falsely sold a computer on gumtree, I was not told it does not have a version of windows on it, otherwise I would not have bought it.
Also I know I have bought as Seen but I could not try the PC out properly until I got it home and set it up, but as I said again he told me it had a full windows version on it.
I think it was a genuine mistake and he did not mean to sell me it without windows, however does not want to give me my money back, and keeps apologising and telling me just to buy a new key. If I could afford a new key I would not be buying a second hand PC on gumtree.
So where do I go from here? I've messaged him asking for my money back, but he's saying he's already spent it on a laptop and that the computer is fine in working order n that he's so sorry etc. so I'm really angry, however feel I can't get angry with him coz I don't think he knew, however I've been fasley sold something, I would not have bought the computer if it didn't have a full windows version on it.
can anyone offer me any advice where to go from here? Thanks

As long as he didn't tell you it had Windows when it didn't then he has done nothing wrong.
A PC and Windows OS are not inextricably linked. If he had bought the Windows key separately then it is his to keep.
If the hard disc was blank then it was no mistake. He was selling it without an OS. He didn't have to mention the fact either, the onus was on you. The fact that you didn't check what you were getting for your money cannot be blamed on the seller.This is a system account and does not represent a real person. He told me it had a fully installed windows system on it when he sold it to me, surely that's fasley selling me something and he should refund my money as it does not have windows on it?0

A seller would know whether there was an operating system installed (as that's how the computer communicates with the user), unless they bought it and sold without trying it out.
However,in a private sale, if you don't have any hard evidence that a fitted operating system was claimed, you will find it difficult/impossible to prove your case.0 -
Just download and install a user friendly linux distro such as Linux Mint or Ubuntu. Won't cost you a penny and no techie skills required, just follow the on screen instructions.0

What did the advert say and do you have a copy of it?

So does the machine have no OS on it at all ?
Or does it have a version of windows that has not been activated ?
No matter how much he apologises, If he told you it had windows on it when he sold it to you - and it didn't , then I would be going back and politely inserting it into his mouth.
Cheeky get has spent your money on a working machine and left you without one.
What version of windows is on it, if any ?
Is there a licence sticker on the machine ?

The only thing that matters here is what the advert said, if the advert said *in writing* you were purchasing a copy of windows with the computer you'll have a few routes you can take.
If not you have received exactly what you paid for and have no leg to stand on.
