Correct, and this thread has added something else into the equation I never considered, he does have his own account in his own name, that I don't have access to, nor do I ever see the balance / statements. So why not use that?
If you divorce, everything in his account will be counted as marital assets and included in the settlement.
If he has hidden money in his father's account, you won't get half of it.0 -
I don't want to take my name off the joint account while we still have a joint mortgage, it's the only way I can make sure it gets paid and he does pay his share of that, if I didn't he would let the account go into the red and then the direct debits would start failing.
I think you guys have hit the nail on the head, he could very well be putting money in his fathers account to make sure I'm not entitled to half, but he would be entitled to half of any thing in my name. Either that or some kind of double life0 -
Is this mainly about hiding money from you, or perhaps also from the taxman?
Or is the father having a hard time at the moment, and this is just temporary to help?
His father is pretty wealthy. Def not the taxman as the cheques I know about are from paid employment and I've seen the wage slip with tax deducted0 -

But there's no need to keep all your money in the joint account when he is keeping some of his in an account in his name and more in his Dad's account.
Either of you can withdraw money from a joint account - you don't want to find he's taken it all out one day and walked out on you.0 -
My point was that the bank only ever have the name on a cheque to decide whether it is valid to pay it into an account. The whole system would become far to cumbersome to use if each cheque had to be made out to some identity that is unique to an individual.Made out to him not his father of the same name. For the record he does have his own account in his own name, so yeah he could be paying them in there as well, but he isntloose does not rhyme with choose but lose does and is the word you meant to write.0 -
Who is writing the cheques?
If you ask for cheques to be made out to both of you they can only be paid into a joint account.
Do the OH or FIL have middle names that could go on cheques?
Sorry this is happening to you, as you've identified the issue isn't with the bank.0
