    I had exactly this kind of issue with my Dad's estate. I ended up constructing an income / expenditure schedule to show that the gifts that just exceeded the exemptions were clearly from income. A bit of a ballache, but I felt much better for knowing it was correct and HMRCS had no issues with it.

    I wouldn't panic. I was worried about that sort of stuff until I saw my solicitor who said they won't worry about that and my mum's estate went through with no bother!
