Reclaiming PPI from American Express

Initially I am just trying to get copies of my credit card statements from Amex (as per the template letter here, I haven't mentioned that I am trying to reclaim PPI).

The problem is I haven't got any account numbers. Amex are saying they can't trace me. I have quite an unusual surname and I gave them my date of birth and a couple of addresses that they would have had on file for me at around the time that I had the card (this would have been about 1999) but they still say they have no record of me.

I can't believe that in this day and age that they can't trace me. I have successfully claimed back over £1000 from Northern Rock for a loan I'd taken out at around the same time and I had no account numbers for them either - just the details above and the inkling that I might have been charged PPI.

Is there anything else I can do?

    Its is very possible that they can't trace you, most lenders keep records for 6 years and you are talking about 10 years longer than that.

    Just to let Vesseur know that Amex could trace my PPI back to 2000 hope that this helps your fight . I wouldn't expect any quick fixes my fight with them through the F.O.S is fast approaching the 5th year.

    I have spoken to the F.O.s today and have been told that Amex have been told to make offers to all customers who purchased ppi after 2002. It will take longer for those who have purchased prior to this date as their records are scratchy. So in my case it will take longer but it does prove that records are available from 2002

    That doesnt make sense. Each complaint is made on its own merits. No provider has been told to refund on all cases and its not in the remit of the FOS to be able to do that. The FCA are the only ones that can do it.

    A major ruling like that would get media coverage too as the FCA publish decisions like that.

    It would happen if the business agreed. For example, a certain business agreed some years ago to uphold all complaints concerning PPI on credit cards where the policy holder was a civil servant. Another example was where the same business upheld all complaints before a certain date because the application form used before that date was rubbish.

    It wasn't that FOS (or anyone) told the business it would have to uphold these complaints. But a discussion along the lines of "we are upholding these cases, we will keep doing it - so it might be an idea to make it easy on yourself..." would be had.

    Maybe this happened here?

    The issue is that Amex have not calculated the ppi refunds in line with the F.O.S and the issue has taken years to resolve. The F.O.S are now telling me that they are happy that Amex are now calculating in line with the way they want them to, so Amex are now in a position to make offers. This only applies to those who took ppi out after 2002.
    This obviously only applies to the ones they are dealing with

    In the end, nobody is required to redress a missale that there is no evidence ever occurred.

    The 5th Data Protection Principle says, "Personal data processed for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes."

    In 1999, the possibility of needing data to defend a claim for misselling PPI 16 years later would not have been anticipated so it would seem that they could have reasonably concluded that it must be discarded.
