Travel insurance claim

Hi, just after a bit of advice if anyone can help?
We were due to go on a family holiday in August this year but unfortunately 2 weeks prior to departure my father-in-law, who was travelling with us, was unexpectedly diagnosed with cancer and we were forced to cancel the holiday. My wife and I paid for our flights for us and our 2 kids and my father-in-law paid for his flights and the villa accommodation for all 6 in the party.
We have successfully claimed off our travel insurance for our flights but my father-in-law's insurance company are quibbling over his claim. They have paid out for his flights but will not pay him out in full for the villa even though he paid for it himself as a 'treat' for the rest of the family. They say they that they can only pay him out for his share of the villa and his wife's but not for our share of the villa - they say that we must claim for it on our insurance but we have never paid a penny for the villa! Surely this cannot be right as we would be claiming for something we've never paid for, i.e. fraud???
Can anyone shed some light on this one please?

I can possibly see where the insurance is going with this.
They may think that the FIL has already taken money off you pro rata for the villa and when he claims the full amount from them, he will not pay you back so make a profit.
You have lost out on accomodation so need to claim from your insurance to get the money back-then pay it to the FIL

I think the FIL insurance co is trying a fast one here so they do not pay out the full amount
I think the FIL should contact them again and categorically state he paid the full amount and is entitled to it all back .0 -
He needs to raise a complaint.
The first people he speaks to probably are following a yes/no flow chart or something that is ok for maybe 90% of claims. When it gets a bit more complex then he needs to speak to someone who is allowed to apply a bit of logic to individual cases.0 -
He needs to give them details of your insurance and the claims that you have made... probably the various insurers will end up sharing the loss.0

You're probably right about the experience, or lack thereof, of the person dealing with the claim judging by the further requests they made of us following submission of the initial claim forms; they were asking questions that'd already been answered by us and requesting documentation that we'd already sent....very amateurish all round.0
