Yep it needs to be in by 31st online with POPLA.

You can't use point #6 at all about keeper liability, as you have already said who was driving. That's what I meant earlier; you have to scratch that whole appeal point as you can't use 'relevant land' or 'no keeper liability' now.

This sentence seems to contradict your case (?) and has a typo:
There is no signage at the bay location indicating that parking is permied in this bay as there is clearly displayed at other bays in the car park.

You need to add something about the alleged contract failing when considering the 'Aziz test' so search this parking forum (not the whole of MSE forums) for the word 'Aziz' as it's a newer point.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • That's great thanks, I'll do some more editing and research.

Is there any merit in leaving section 6 in and leaving it for the assessor to rule it as irrelevant or maybe even just lacking in credibility?

It's fine - you shoud win but new POPLA is an unknown quantity until we start seeing decisions to know if they are consistent with 'old POPLA'.

You definitely need the 'Aziz test' covered because you can word it so it's almost impossible for the parking firm to reply to. Have a search because I'm sure there is a thread or two with suggested 'Aziz' POPLA wording mentioned.

A Wikipedia search has helped me to understand the aziz test, still searching the forum for previous wording, but I hope this helps someone out there.

I tried to post a link but no yet allowed

I wonder if your appeal point 4 has any merit. From reading this forum and contributing for quite some time, I do not recall ANY POPLA appeal being won on this point.

In addition, it just makes the appeal that bit longer and, in my opinion, one should keep the appeal relevant and not verbose. Certainly we have seen winning appeals losing because the winning point was submerged in excessive waffle.

I would take it out completely.
  • Just received an email from popla

"Meteor Parking have told us they do not wish to contest the Appeal. This means that your Appeal is successful and you do not need to pay the parking charge."

I have to say a huge thank you for the advice I received so promptly and fully. I am obviously really pleased to have successfully appealed.

To everyone else who reads this. The conduct and basis that these companies operate on is quite frankly disgusting. Spread the word, they are ripping unsuspecting innocent people off. Let's stand up to these people. It's not that difficult and it doesn't take much time either - when you have such good people helping you.
