I have just noticed this topic area posted in wrong one I think.
For probate we have a little problem on the deeds there is another name but the person doesn't exist... how does that effect probate for one person...
basically hubbys dad died 16 years ago, and is still on deeds and now his mom a gone,,, should we get his dad off first before probate??

Part of the house still may still belong to the estate of your husband's late father. Was the property held as joint tenants or tenants in common?I have just noticed this topic area posted in wrong one I think.

Easy enough. Contact the Land Registry and explain the position. They will probably need the death certificate and possibly a copy of his Will and your Mothers Will. Let us know how you get on.

If Dad and Mum were 'joint tenants', then Mum became the sole owner when her husband died. All that's needed is the two death certificates and probate for Mum's will so that the executors can change the ownership or sell the property.
If they were 'tenants in common', it may be a little more complicated, depending on what happened to Dad's estate when he died.0
