IAS Appeal Rejected - £35 charge

Hi,

Apologies if this has been discussed previously (I couldn't find this anywhere?).

My appeal has been declined by the IAS, so am I now prepared to pay the charge (obviously I don't agree with the decision but this is as far as I'm going to take it).

I logged in online and noticed the charge is now £137.10 - This must include a £35 charge for appealing, there is nothing mentioned in T&C's on PCN re: admin charge for appealing - is this valid or has anyone experience anything similar?

  • I would like that to be the best outcome although don't think I can be bothered with the hassle.

    I parked in a private car park and was unable to pay in advance for the parking (they had free parking until 8:00am the next day). I'd presumed that machine was broken when it wouldn't let me pay the £2. I videoed this to make sure they could see that I'd tried to pay.

    It turns out the machine wasn't broken, rather wouldn't let me pay in advance. I returned the next morning around 8:30am (Charges starting from 8:00am) to see the PCN had been issued at 8:13am.

    I then appealed with NPS who rejected it, and then with the IAS who also rejected. I now have £137.10 to pay for parking that I couldn't purchase at the time :(
  • Post up the decision and tell us which parking company. We need this info for starters.
  • Details of the decision:

    "The Appellant claims they attempted to purchase a ticket but they were unable to do so.

    The contractual terms advertised on the signs at the site make it clear that any driver parking without a valid ticket between the hours of 0800 and 1800 will be issued with a parking charge. The Appellant accepts they were parked between 0800 and 0820 without a valid ticket, whatever the reason; therefore they agreed to pay the charge.

    The Appellant believed the machine was not working but the Operator has confirmed that it is not possible to purchase tickets for the following day. This makes sense as it is not common to be able to do this except where overnight parking requires a payment. The reason the Appellant could not purchase a ticket is irrelevant. If the Appellant could not purchase a ticket it would not alter the contractual terms. The Appellant was aware that if they remained parked beyond 0800 the next day without a ticket they would have to pay the ch arge. They could have moved the car before this time, or attempted to purchase a ticket before 0800. They chose to return after that time and I must dismiss the appeal. "

    The ticket has been issued by Northern Parking Services.

    name of assessor? if they haven't supplied one then demand they re assess and provide an adr regulation compliant service.

    Am I reading this correctly? The appeal is denied because:
    "They could have moved the car before this time, or attempted to purchase a ticket before 08:00" which is what you tried to do but the machine would not accept your money
  • There is no name on the decision rather just signed off as the IAS.

    I can make the request as you've outlined, but is this going to progress my case or is it just essentially a delaying tactic.

    I'd be interested to hear anyone's thoughts on the £35 charge specifically?
  • Yes I attempted to purchase the parking at around 7:30pm this was in the free period on the machine.
