Lost job, no notice. What do I do?

So yesterday me and my partner (both worked for same company) lost our jobs. He was the general manager and was told he needed to go sign a contract with a new brewery, but when he got there the owners told him that they had sold the building to another company and as of then we were shut and to tell us all we no longer had a job. We are getting this week's pay and thats it! We never had contracts or anything so I'm guessing there not entitled to give us any notice or pay. I have no idea what to do now I've never been unemployed when old enough to get benefits ect. Who do I speak to about it all? I have a 2 year old son and 300 quid to my name until I can get a new job or some benefits sorted.

    Just because you don't have a contract doesn't mean you aren't deemed to have a contract. If the original co has gone into liquidation then the redundancy payment will be paid by the gov. Someone will be along shortly who knows more than I do. Your jobs may be gone but at least you should have some redundancy payments & holiday pay due etc.

    You need to find out what has happened to the company you did work for.

    TUPE may apply if someone has taken over the operation.

    Statutory notice 1 week per year service(up to 12) and redundancy if 2years or more service first port of call is the owners for that money.

    How long have each of you worked there, and how much were you each earning?
    Assuming you had worked there for 2 years or longer you are entitled to statutory redundancy pay whether or not you have a formal contract. There is a calculculator here

    to work out what your entitlement is.
    If the original employer has gone bust then you should be able to make a claim from the government fund https://www.gov.uk/your-rights-if-your-employer-is-insolvent/overview
    Depending on whether the original owners have sold the company or just the building, it is also possible that you may have been TUPEd'd across to the new owner (if they bought the business)

    Check whether you have any insurance such as home insurance which includes legal cover, and if so, speak to them to see whether you can get to see a solicitor. If not, try the ACAS helpline.

    If you were employed for less than 2 years then may not be entitled to much more although even then your should get a week's pay in lieu of notice, in addition to any pay you have already earned, and pay for any holidays accrued but not taken.

    It will depend if the original employers sold the business or just the building to the new company. Was this their only place of business or are there other trading locations still running. In other words has your place of employment closed or has the whole company gone bust.

    Without the other answers- length of service hours and rough salary it's impossible to give much more advice but I can reassure you that you don't need a contract to be able to claim any owed redundancy from the government scheme.

    You had a contract, though not a written one. Both have equal validity in law, but the issue with a verbal contract is proving what it said when situations like this arise.
    No free lunch, and no free laptop ;)
