Did he have his lights on? Not trying to be funny but do you think that sort of argument would stand up for insurance claims if he hit another car, or in court if he hit a person?
A hole in the ground is very different from a car stopped with no lights on or a person with dark clothes on.0 -
Were they not aware of this pot hole or issue given you have been in such lengthy conversations with the council about it?

To clarify, I informed my partner I had emailed the council about something. I didn't go into great detail e.g. exact location. I mentioned it in passing but there wasn't much to make a conversation about.
I knew about it, and raised the issue several times however my partner was picking me up from work. This was a rare occurrence and he doesn't normally drive that road, hence didn't know exactly where it was (and me explaining that I didn't warn him as I was too busy moaning)
It isn't clear in the dark. Not only that, but when it rained it wasn't actually visible at all (not that it makes a difference) but for the sake of arguments I saw drivers drive quite quickly over and get a bit of a shock as the water covered the depth.
The reason the photo's are so old is because it happened in January. It had taken the council around 4-6 weeks to reply to each of my letters (and then obviously a week or so for myself to respond.). There letters were very incoherent and full of mistakes. Not only that but they kept ignoring questions I asked. So, in total I have about 7 letters from them over the year (it would only have been two or so had they done a better job in reading/understanding the ones I sent)
I see consensus is previously poorly spring. (although I stand by the temporary repair being no use)
I get what i want. That isn't because i'm a brat or spoilt. It's because i'm determined, i work hard for it and i achieve my goals!0 -
Fit a new spring and drive over the same spot, if the spring breaks you have proof it was the road condition. If not it was spring just waiting to fail.
