Default question

Hi,

Partner has a default from when her ex-husband went bankrupt, thus putting the overdraft (he took out) on their joint account into default status.

Have been paying various DCAs £5 a month for a while now, it's approaching six years and a DCA agent said to my partner once its passed six years she doesn't have to pay anymore and there;s nothing they can do (obviously doesn't value his job!)

From my understanding, this isnt right as making payments means Statute Barred doesn't apply? Can someone confirm please?

Would love to stop paying someone elses debt especially when they walked out of bankruptcy and into a well paid job :mad:

    DCA phone staff are often pretty clueless. Either that, or they know that their firm just doesn't bother to take legal action. There would be a risk of it being sold to a DCA that does though.

    Think it most likely the person was just talking nonsense.

    Payments by a person liable on the debt restart the 6 years on the Limitation Act each time.
