Minibus Cancellation without deposit

Hi All,

Thank you in advance to anybody who takes the time to read, reply and help.

I have enquired with a number of minibus companies in the past month, for an event tomorrow.

One quote was the most competitive and so I pursued that receiving a quotation based on numbers, times and number of drop offs. I have been trying to pay for it for most of this week and the woman has been impossible to get hold of to pay over the phone despite her saying that she would rather the driver not take cash tomorrow.

I have found another company to do it for the same price and am at a point where I would like to give them the business as they seem helpful and prompt, and cancel the difficult company.

I have not paid a deposit. Of course their terms and conditions include a cancellation policy but I am unsure where I stand if no money have been paid. Does it remain at quotation stage and thats that until money is paid and it is confirmed? Where do I stand?

The contract is formed by offer and acceptance and is not money related. They offered the service at x price and you accepted. Why would not being able to give them any money yet concern you?


Have they given you any reason to believe they can not deliver the service? It would be difficult to say they are in breach of contract at this stage.
