Rear extension boarderline wall on neighbour side

I recently have purchased a semi detached house and have put in application for extension of 6 meter at the back under neighbour consultation. We had a visit from the council and they said will let us know their decision by end of Oct-15 as the publicity end date is today.

The plan that we submitted shows the wall of the extension to the neighbour is not in line with existing but leaving some space. Currently the neighbour has got conservatory but he has left some space too. So I have asked the architect if we can rather use the space and build in line with our existing property. He says we can just ask the neighbour if ok as we do not need to change the plan and can amend it on building control plan.

Does this sound correct? Can the neighbour object to that? Even if they object, can we still do it as it is at the end of the day our border line?

    I can't comment on the legalities of this, but consider if the roles were reversed. It's generally a good test of reasonableness.

    Would you be happy with them building right up to the boundary ?
    Then having access across your property every time they wanted to maintain it ?
    And you not being able to build up to the boundary after due to the access issues ?

    Would you object ?

    And how well do you think you would get on with them if they then built as you intend to after you objected ?

    Might be better in the long run to sacrifice that foot or so of internal space so you have access to your own wall from your own land.
  • Thank you JP08. Since you asked, I personally don't mind and would not object to that.

    Purely because if we cannot do boarderline wall then it would be as close as possible. In that case if not impossible then it would be very very difficult to get into that space to keep it clean. I also think if they decide to do extension or conservotry or such then they can do the same which again will help them too gain that extra space too and will keep things clean.
