Confused over prize

Just after a quick bit of advice about a prize I won recently.

The competition was to win an iPad (the information about the competition and the terms always used the term iPad). I have just had confirmation through that my iPad Mini will be delivered next week. If they advertised the prize as an iPad and not an iPad Mini then is this right?

This is from their terms:
5. The Prize
The prize is provided by. One (1) winner will receive an Ipad. Please note that we give no warranty or guarantee as to the quality of the prize. If the prize becomes unavailable for any reason outside of our control,we reserve the right to offer an alternative prize of equal value.

Wanted to win an iPad for ages and either way I will be grateful to have won one but I was under the impression when I entered that the prize was for the standard version and not the mini version. Just wanted to see what people think before they send the prize to me.

  • Thanks for the reply. The bit that I am confused about is does the term iPad cover iPad mini as well i.e an iPad mini would technically class as an iPad or are they separate things?

    Normally a competition states iPad mini or iPad but as there was no model mentioned or any photos of the prize I am not sure if I have any comeback. From the moment I saw the competition on here I had assumed it would be a normal ipad and not a mini though.

    There have been a total of seven iPad models altogether - the iPad, iPad 2, iPad 3, iPad 4 and iPad Air, and the iPad mini and iPad mini 2 with Retina display

  • Thanks for your reply. From that would it be safe to assume that they are within their rights to send any model (in this case an iPad mini) if the terms only stated iPad.

    As I said in my original post I am please to have won an kind of iPad, just wanted to double check they weren't pulling a fast one before they send it to me.

    I don't do apple products but I suppose if they could be held to "iPad" it would only be to the old one from 2010 and not an iPad 2 etc as if 2 can come after iPad so can mini etc.
    I have seen comps where they are clear and say ipad mini, air etc

    I would term iPad as the category of devices, with each device having it's own model name. They really SHOULD have said mini though for clarity, but it's easily done. My mum calls her Samsung tablet 'an iPad'. It does my head it. She means tablet.

    But, yes, I agree with others. "iPad" would mean any one of the models, just most companies state that they have the right to send you whichever model x

    it does state an alternate prize would be given maybe they couldnt get hold of a regular one

    I would imagine it depends on who was promoting the competition, if it was say Bauer or The Express group then I would assume an iPad is and iPad as any other variations are normally stated but if it were a small company any iPad could mean a mini I suppose.

    I'd be more worried about the part in the terms that says they do not offer any warranty or guarantee of the quality of the prize.

    Very poorly worded. Was this with a reputable company?
