Judgement by Default

Hi

We have applied through Money Claim online for a debt owed to us (related to fees of a previous debt which we have now got back through 18 months and bailiffs). The defendant has ignored the initial claim and it looks like a judgement by default has been issued - it shows this on the website and also on Trust Online.

How long do we wait before we start progressing further to a Warrant of Control. Is there a limit on how long we have to wait for the immediate payment given by the judgement by default?

    A judgment will usually have a Pay By date. Once that date has passed you can proceed to enforcement. (AFAIK).

    A default judgment will only have been issued if you asked for it.

    The standard time for compliance is 14 days, if the Order specifies "forthwith". Have you not got a copy of the Order?
  • We asked for a judgement by default after the 14 days as we had no response from the defendant at all either to accept that they owed the money or not, or any defence? I have a copy of the judgement but doesn't look like an order?

    Can you post a copy after removing any identifying details?
  • The thing i have is an N225 which is a request for judgement, i can't seem to figure out how to post an image (can you help) yet on money online it says in the history

    Upload the image to a photo hosting website, photobucket is one, and then post a link to that image.

    Unfortunately, as a new poster you will not be able to post a link directly, but just camouflage it by inserting a space or two.

    Thanks - I don't use MCOL but I would expect you to get a copy of the formal Order either online or in the post.
