renting

Hi all I put down a holding fee of 425. They give the 425 back to the landlord saying the application. Went onto long but I pass everything. And now they put the house back on the market. I have not back out.

Here the recipe they gave me when I Frist apply.

•Please note (Credit check fee / Holding fees) are none refundable. If
the Landlord decides not to rent the property to you then your Full
Holding fee will be refunded from the Landlord direct.



•Upon Lewis William receiving money on account for the above property
please note that it is none refundable if the tenancy does not
proceed, if the landlord decides not to proceed with a tenancy then
the landlord will refund the monies to you.

    Wrong wrong wrong. You paid the agent the money. They owe you the refund.


    They cannot pass on the obligations to a third party.

    The letting agency has trousered the £425.

    Have you actually been told that the property will not be let to you? Is it definitely back on the market or is it just still being advertised in the letting agency's window/website? Some letting agencies continue to advertise properties even when a tenant has been found to make their portfolio look bigger.

    If it's the case that you have been referenced and the landlord has decided not to let to you then send a Letter Before Action to the letting agency requesting your £425 back.

    I refer to the holding fee of £425 paid to you on (date), for the advertised property at (address).

    Having passed your vetting process, and being willing and able to take up the tenancy as agreed, kindly either

    * provide me with a tenancy agreement for the property or
    * refund my fees in full

    Kindly complete one of the above two options within 5 working days.
