Golf club accident??

Hi..my son has played a shot...hits car of golfclub worker and breaks windscreen. Car parked in golf parking area. My son has paid club for round of golf...man demands £230 for repair. Club have now paid this to their employee...they now want him to claim "house ins"...he lives with us....surely this type of accident will be covered by the club?...and be covered in the fees for the game. any comments welcome.

  • When I played local cricket we were advised to park our cars outside of the ground as most clubs insurance would not pay damages if your car was hit by a ball within the boundary of the cricket club. If a ball was hit out of the field and damaged something beyond the land boundary, it was covered by the club's insurance.

    Not sure how this compares to golf though.

    This would be determined by the terms and conditions of the golf club I guess.

    I think they are being very hopeful in trying to have a claim against your son and the house insurance.

    seems the car was parked on the 10th green, near to hut with equipment in...google earth map shows this in actual centre of the golf course...! I doubt the car was insured for such work.

    Was the car in a designated car park eg the car park the members use or was it a hard standing that only the employees use when working on the green?

    Adjacent the 10th green...this green is in the middle of the entire course....no surprise a ball hit it!

    Determined by case law, and liability.

    They've suggested house insurance because most policies include public liability cover. Public liability is the cover to claim under. Some golf clubs provide cover for their members, but if the club have made this suggestion then they presumably don't (but you could still query it). Certainly not all clubs provide it.

    My hubby used to have specific golf insurance, but we then realised that our house insurance provided ample PL so he cancelled it. We checked with the house insurer that sports, and specifically golfing accidents, would be covered.

    The bigger claim can happen if he plays a shot and the ball hits someone, as golf balls can cause severe head injuries, so it's worth making sure there's cover in place through some channel.

    First thing would be - is he a member of the golf club, or was he just doing pay and play? Then he could ask the club if they provide insurance for members and/or guests.

    This has all been muddied by the club paying up then wanting the money back. Had it just been between the person and your son, they would have negotiated. Man would have wanted the repair paid for. Your son could have paid himself, claimed on insurance, or refused. Man could have then tried a legal route (small claims) if he could be bothered. I don't know what the legal standing is now that the club have footed the bill and are trying to reclaim the cost.

    The car was parked near sheds to right of T off and hole ...hard standing. ( see map)...the sheds are peppered with golfball marks. Seems to me the car was in a vulnerable position....as proved by the fact it was hit. Golfclub lady asking Tom to pay up.....car parked in hatched area.
