Told no 16 months ago now told yes..HELP

Hi

I need a bit of help. I went via a 3rd party in May 2014 to reclaim my mis sold Ppi. I received a letter from my credit card company to say that they did not mis sell. I also received a letter from 3rd party saying i was unsuccessful and they have closed the claim.

Out of the blue yesterday I received a letter from Barcelycard to say they were reviewing everyone claim and found they had in fact missold and have awarded me some money. As this was so long ago i contacted them to ask if this was via a the party or if i requested the payment via chq or credit against my card. They told me that as it was so long ago the third party have no claims to my award.

Now I have received a letter from them saying to accept the award I must contact them (even though barcleycard have sent my chq to me directly) and they want £750 fee.

Am I right in saying that they have no claim to this as this was over 16 months ago and the case was closed?

Any help would be great

    No.

in cases like this, it is normal for the CMC to request their payment. Whilst it does highlight the complete waste of money that using a CMC is, it doesn't change the fact that had it not been for that initial complaint letter being posted to them (which is all a CMC does), then this outcome would not have happened. And therefore you owe them the money.

A caveat to that would depend on how they worded their service closure. i.e. the letter to you saying "i was unsuccessful and they have closed the claim".

it is normal for you to be paid directly. You pay the CMC after. Barclaycard obviously notified the CMC which is how they knew to contact you.
