Title Deeds Not Changed In Time

Hi,
I'm posting this in behalf of my husband who has just been contacted by his ex wife asking him to sign the house over to her as she is selling up and moving to Spain...

Hello there and many thanks for taking the time to read my question.

My wife and I divorced in 2009. In the divorce hearing, the jusdge awarded her the house and set time limits (a) for me to collect my belongings and (b) for her to complete a transfer of ownership, solely to her name. She now wishes to sell the property and it has come to light that she never complied by removing my name. This means that she needs my signature to sell the property. Where do I stand legally?

Any advice or experiences you've had would be gratefully received.

apologies if this isn't the correct board to post on.

She needs your signature anyway, whether to transfer ownership to her name or to sell to a third party. The court order apparently requires you to sign. I don't think the delay makes any difference.

The issue is that it had to be done in a set timeframe, which it wasn't, so technically my husband is co-owner still, what he wants to know is as she didn't complete signing on time, does he now have any rights to a share the house? Otherwise why was there a time limit imposed?

The deadline was stated to bring things to a conclusion, not for your husband to go back and grab a bit more money.

Nice guy you've got there. Keep in mind one day you could be the ex ;)
  • what a greedy, money grabbing harridan.

I'm really pleased she's married to someone else

No, the rights he has in the house are those stated in the court order.

In order to give his ex (and him) some time to sort out remortgaging and transferring title, and so that each of them can enforce it after the deadline. It doesn't mean anything magically changes after the time limit.

Does your partner want to be in breach of a court order? This is an argument you cannot win.
