parking ticket on my car in my space- what process??

Hi all

Can't find any other threads that seem to relate to my problem. Bought a new build house 2 years ago, at the time was told council would take over the road but that never happened and estate managed by various property management companies since. All the houses have their own parking spaces, numbered and mine was on the deeds of my house so am assuming I own it alongside the rest of my house and garden.

As we are close to a train station there was a problem with people parking in private spaces during the day. The management company at the time brought in a permit system whereby residents needed to display a permit with their corresponding house and space number on it. I've never agreed with this- it's my space, I don't need a permit to use it or to be dictated as to who can and can't use it. The parking is overseen by CPM. I have received numerous tickets on my old car but as it had a foreign number plate on it, I threw them away and nothing ever came of them.

However bought a new car, UK registered so now any tickets I receive will be followed up I imagine. I received one at 1am on the 27th of September (they send the parking inspector around in the middle of the night now so people can't move their cars when they see him coming and also because there has been massive rows about the whole issue in the past). What is the best process for appealing this? I don't see why I am obliged to display any sort of permit to park on MY property. In fact the ticket says it was issued as vehicle was parked on private property. I know it was! MY private property. In my eyes the parking company is in the wrong as they were trespassing onto my space. Am I deluded here and just need to bite the bullet and display the permit? It sounds petty but the reason I don't do it is because the management company have caused me huge issues in the past, think they have control over what free holding residents do and I never agreed to having the parking managed in this way in the first place. Which I made known at the time and was told I didn't have a choice. But I never signed anything giving CPM control over my parking space. Any advice?

    Some company you never contacted are running a profit making business on YOUR land. It's the equivalent of a bloke parking a burger van on my driveway and selling to people at night.

    Dear Management Company,

    I hereby withdraw all implied access to my land, including but not limited to the parking space identified as [ ], to you, your employees, agents, and sub-contractors (including but not limited to CPM). Any repeated incursions onto this land for any purpose (including the affixing of speculative invoices to any vehicle parked in this space) will be considered as tortious interference with my property and legal action may be taken against you accordingly.

    As you say, it is your space, you do not need a permit.

    They are IPC members so it is unlikely you will win an appeal, but appeal anyway and, if they persist, follow the Manxred's advice and, if you are so inclined, that set by Mr Davey.
    You never know how far you can go until you go too far.

    Might still be worth checking your deeds for any T&Cs in respect of the parking place, just to rule out anything that might infer a permit is required.
