i really need help in this matter from a solicitor if poss

my dad died and left a will gifting 5,000 to 20 of his grandchildren and the remainder of the estate split 3 ways between my 2 brothers and my mum well its all gone through now and the 5,000`s have been gifted and mum has recieved her final letter to accept the costs etc which is all fine but my 2 brothers are being really horrible to my mum and it says on this letter that until all concerned papers have been signed and returned that the money wont be paid i dont understand that bit but also is there a time limit on this as i have got a feeling my brothers deffinatley wont be rushing to get the paper work returned i think that they are enjoying seeing my mum wait as they are not in need of money my mum is plz can anyone shed any light onto this situation as to how long my mum might have to wait thank you in advance xx i hope this is in the right place xx

    I am not a solicitor, but I suggest you contact the Citizens Advice Bureau as soon as the Bank Holiday is over. If they can't help, they will certainly be able to point you in the right direction for free legal advice. Good Luck

  • Well I'm not a solicitor either but the solicitor dealing with my FIL's estate simply sent two copies of the accounts relating to the estate to hubby along with a cheque for his share of the residual estate and asked him to return a signed copy of the accounts.

    On a separate issue it sounds as if your brothers need a good kick up the behind and I hope that your mum remembers how they acted.

    I am really sorry for the trouble your mum is having. I am going through a similar situation where my sister is being completely poisonous!
    What is important is who are the executors of your dad's will, because once the estate has been granted probate and the tax issues dealt with, it is their legal responsibility to distribute the estate according to the will. If they are the executors and not doing their job properly then maybe the CAB can help your mum kick their backside and make them do it properly.
    It could be that someone like the CAB who is outside the family is just the impetus you need to stop the problem.
    If they have any respect for your/their dad, then they should carry out his wishes, and not put your mum through any more than she already has to deal with.
