PPC Harassment

Do we know of any examples (successful or not) of taking a PPC to court for harassment (either as a private prosecution or the CPS)?

well new customer rules come in today for consumers , people in the UK are going to be able to do the equivalent of the American "class action" , so maybe , just maybe a nice solicitor/lawyer might want to place advertisements inviting people who have/are being chased by the likes of DR+ to contact him , in order to start a class action against them
hell , we could start on MZZ rossanne ,,,,,,, next0 -
I thought I remembered someone going fairly far with UKPC about an owned parking space in a residential development, in which he was given damages. It may have been for trespass though rather than harassment.0

yes , correct there was a case reported on pepipoo and elsewhere about this

Harassment is massively difficult to prove. Just look at the lengths (and expense) Ms. Ferguson had to go to in her harassment case against British Gas.Je suis Charlie.0

Proving harassment in a court of law, especially wrt a PPC would, I expect be an uphill battle. Letters from DCAs are not imo harassment, otherwise the Readers' Digest would go out of business. Knocks on the door (TVL) and telephone calls might be, but few PPCs resort to these, (although banks do I believe).
In any case, if you are assertive enough, you can rein in TVL.
I believe that Roger Davey, a barrister, who was harassed, received very little in damages for harassment, most of the money UKPC paid to him was for his time and court fees.
Unless you have money to burn, I would not go there. You never know how far you can go until you go too far.0 -
I just report them for not having a TV licence , and apply for readers digest in their names ,0

Letters can be harassment. It was all postal in the Ferguson case, but there were a lot of threatening but entirely unjustified letters.
A feature of her case was the number of times she had written to BG telling them the debt was denied, so anyone who seriously contemplates a case against a PPC needs to reply to every letter, denying the debt.
Davey didn't sue for harassment, he sued for trespass. The bulk of the payout he received was costs rather then damagesJe suis Charlie.0 -
Now this is harassment

Thanks for that TD, priceless! It takes a very special kind of f***wit to apply to a magistrate for a warrant to cut off a gas supply that doesn't exist!Je suis Charlie.0
