Two damaged deliveries and four dates with the delivery man - what are our rights?

Hi,

Recently purchased a wall mirror from AQVA (Leicester). Item was ordered over the telephone.

We were given a delivery date. The item was well wrapped in the manufacturers packaging and a secondary box. However, item arrived damaged (broken glass).

Immediately contacted AQVA who advised the mirror must be collected and processed before a replacement would be sent.

Delivery date received and another day at home waiting. The mirror again arrived broken. ON NEITHER OCCASSION IS THE DELIVERY CHAP PREPARED TO WAIT SO WE CAN CHECK.

Immediately contact AQVA who again arranged collection. They blame their supplier.

We now await delivery of the third mirror - everything cross it is not broken!


What are our rights? We were happy to wait at home for the first delivery - we accepted this at the time of order. We have however now had to wait home for two broken mirrors to be collected and to date a second broken mirror to be delivered. Assuming the third mirror arrives unbroken then we have had to wait home on FOUR FURTHER occasions.

Both my wife and I work 20+ miles from home so cannot easily pop home. Instead we're exhausting holidays in order to meet the delivery driver.

Your advice please (other than avoid AQVA!)

  • How do stand if we have had to exhaust our flexible holidays in order to be at home? We have not lost money but have wasted holidays (that cannot be replaced).

    Charge them for the cost of the wasted holidays so you can take unpaid time off?
