VW Diesel - Section 75 Protection

As an owner of an affected VAG vehicle with the Euro V 2.0 TDI engine, could anyone enlighten me as to whether Section 75 would apply under the grounds of breach of contract / misrepresentation if a vehicle was purchased new from a main dealer with a £1000 deposit paid for using a credit card in 2011? The remainder was funded through VW finance which also entitles me to Section 75 if I am correct?

    yes, but it has not been proven yet - lots of court cases to come.
    I also understand the present owner may get the full purchase price back, even though the vehicle maybe 05 reg.
    Its going to be very interesting times for VW

  • S75 should apply but IMO it's pointless claiming yet because as far as I know there hasn't been any definitive figures given as to how much an affected vehicle will decrease in value.
    Without knowing this figure, a claim would probably be rejected.

    The purchase price was greater than £30k in my case so from my limited reading on the subject this makes this purchase exempt from Section 75?

    That's right. Your purchase is not covered by S75, for the reason you mention.

    However, Section 75a of The Consumer Credit Act, introduced in 2010, may help.

    S75a covers some purchases up to over £60,000. See the appropriate section of MSE's Section 75 article.
