Help advice needed due to exchange but do we give in rental notice ??

We are buying our first home 40 miles away from where we currently
Live.
We are very close to exchanging contracts (solicitors have pencilled in 6thoctober)
But our current hiuse needs to be handing in our notice as our rental contract ends the first week of December.
So nervous as even though we're putting on pressure our sellers are taking their time with this small chain. It's only us (in rented) and theirselves ( which are returning to renting due to relocation )
I'm so stressed I'm not sure what to do? Hand in our notice and just keep everything crossed we complete by December but if it doesn't we could be homeless (with our 3 children)
Help what would you do? Or has anyone been in this situation and what did you do??

You shouldn't hand in your notice until you exchange. Although once you've exchanged it should only be a couple of weeks until you complete, I can't imagine it would take from October to December.0

When you say your rental contract ends the first week of December do you mean that you are on a fixed term contract?
Plus, what country are you in? England/Wales or Scotland?
Sorry, just realised that you are in England.
If you are in a fixed term contract then you do not need to hand in your notice. You just leave at the end of your fixed term.
However, it is polite to inform your LA/LL of your situation.
If your fixed term ends before you have exchanged then you can go onto a statutory periodic tenancy (month to month) and you then need to give one month's notice aligned with your tenancy period. (but check your contract about this)
You shouldn't be doing anything until you have exchanged.

Agree, don't give notice until you exchange & have a firm completion date.
Usually you can't give a date before end of fixed term: However there is nothing to stop tenant & landlord agreeing any date/time to end matters: And most landlord would prefer a date earlier in November to trying to find a tenant coming up to Xmas: In other words, when you can give notice but try to NEGOTIATE with landlord/agent.0 -
Does that mean you are currently in a fixed term that ends the first week of December? Didn't think you have to give notice to leave at the end of a fixed term although it's most practical to give at least some so that a checkout can be arranged. Stay a day over the fixed term and you will be on a periodic tenancy that requires a minimum one whole period's notice ending at the end of a period. Unless the tenancy agreement makes a contractual periodic tenancy to arise in which case notice is defined in the agreement.
I'd suggest explaining the notice requirements to your vendor so they know the impact of any delay they cause.

If you are on a fixed AST, (say 6 months or 12 months) that ends in December, you do not need to give any notice.
You only need to give notice if you are on a periodic month-to-month contract (which most people get if they reach the end of an initial 6 months and don't sign a new contract). Then you'd need to give one month's full notice (rent date to rent date) at most (this is the most usual arrangement).
It's nice to give notice in this case, but you don't have to.
If you're on a X-month AST that ends in December and if you are exchanging on 6 October, then you'll have your completion date. If, say, that's in October I'd give notice about 2 days before completion.... that way they'd get lots of notice and you won't be inconvenienced by them wishing to drag people round for viewings...0 -

Our contract is fixed term (one year) but we hae been here 2 years in December (this is our 2nd 1 year contract)
Will dig oout the contract tonight and see what it says re giving notice.
But sounds like we need to be patient a bit longer and hope we exchange and complete asap. Its driving me mad all this waiting for soliciors, paper work etc,:mad::rotfl:SAVING FOR OUR FIRST HOUSE DEPOSIT

a) sign a new 12 month fixed term? or
b) not sign anything and move to a SPT? (see link in my previous post above)
You also need to know the exact start/end dates in December.0
