Kitchen Company - Bankrupt

Hi


I purchased a kitchen in 2012 and was advised the kitchen units and appliances have a 10 year guarantee. The company went into administration this year.


I have a problem with the fridge now and don't know who to turn to or even what my rights are.


Can anyone help/advise please?

  • Was the guarantee backed by an insurer? If not, did you pay by Credit Card? If not, you're out of luck

    As above, but try speaking to the fridge manufacturer. A fridge should last more than three years.

    Before you jump to conclusions-

    I havent heard of a 10 year warranty on appliances so who provided it? If it was the retailer, its worthless. I dont know of any appliances (except some Miele laundry) that come with 10 years warranty.

    Your warranty is with the fridge manufacturer and since its 3 years old, your fridge is probably out of warranty.

    If you took out an extended warranty then you should look into that.

    If you paid by credit card you may have insurance cover with the card company so look into that.

    If you have neither and the retail has gone bust, it would be contingent on you to prove under the sale of goods act that the product was faulty at the outset.

    The retailer may have been able to help but unfortunately with the retailer gone bust, you have little choice. Its one of those things in life that you take on the chin and move on if none of the other are of use to you.

    LG direct drive washing machines come with a 10y warranty on the motors but as you say its rare to find anyone giving 10yr warranties.

    yes so do siemens on their motors.

    But thats not the same thing. Its the elements, bearings etc that are more prone to failure on a washing machine.

  • Unless you paid for the kitchen using some form of credit agreement or credit card there probably isn't much you can do. Even then you would have to have some sort of documentation to show that the kitchen company was offering a 10 year guarantee and therefore their demise has resulted in a breach of contract. If you are able to show that the contract of sale granted a 10 year guarantee on everything then it would be worth making a claim S.75 claim against the credit provider; this should still be valid even if you have now paid it off.

    If you don't have anything to show that the company were offering the 10 year guarantee then I don't know how the credit provider would react to a S.75 claim.

    I can't imagine the fridge manufacturer honoring any guarantee but a quick phone call or email to their customer services won't cost you and you don't know until you ask.
