Points: 4 Years/ 5 years?

Hi

I'm confused on the whole licence points expiry thing. I received 3 points in Nov 2011 for a SP50 (speeding offence).

Looking on Gov.uk, these points are due to be removed from my record in November. However, most insurers ask for points in the last 5 years.

My questions are as follows, a) do I still need to declare these points when I renew my insurance in Dec and b) how is this legitimate given the various rules on disclosure of past offences?

    I think these expired Nov 14, can't be removed from your licence until Nov 15 and most insurance companies require them to be declared until Nov 16. In short YES.

    Motoring offences are treated in the same light as criminal offences.

    Declare if the insurer asks. If you don't it could end badly. Especially since there are records from the past 4 years of it being declared.
  • Motoring offences ARE criminal offences, they are non-recordable however.

    If they ask you if you have had any offences in the last 5 years and you have had any offences in the last 5 years, then you should respond with a yes.

    ...and they ceased to count towards a totting-up ban last November, after three years.

    It's massively unlikely that they'll affect your premium, so not declaring them has a potential big downside, and very little gain. Why wouldn't you?

    The length of time insurers can require you to disclose the conviction is set by the Rehabilitation of Offenders Act, which stipulates a rehabilitation period of 5 years for most motoring offences (unless you were under 18 at the time, in which it's a little more complicated). It is entirely separate from the length of time that the endorsement stays on your licence.
