Court Citation- work related

Hi all

In my post there is times that we are involved with the police for various reasons and have to attend court. I have been cited to attend but as it falls on my day off (only day off that week) my employer is refusing to sign off the expenses form, stating that as I am not working I can't claim or it would be fraud. My understanding is that as its related to me executing my role it would be classed as working.

I am going to speak to my union rep but wanted to see othere opinions.

    I'd say that you would only be working if your employer rostered you to work that day, and you then spent the day either at court or doing your normal job or a mix of the two.
  • Is there a benefit to the employer in the cases going to court? Is it fairly central to the role of your employer? Or is it just an irrelevant nuisance?

    1. ask for a change in day off
    2. or ask for the time in court back, so if it is 2 hours in court, you start / go home later one day by 2 hours.
    3. re expenses just speak to your HR / or your boss' boss.

    Since you are attending court in the course of your employment I feel that, not only should you be reimbursed any reasonable out-of-pocket expenses but you should either be paid or be given time off in lieu.

    Hope your rep sorts it, not only for this time but for the future.

  • Will you be appearing in court as Fred Bloggs, 'concerned member of the public' or Fred Bloggs, 'xxx job role'? That's the key.

    For instance, a store detective would likely be appearing as a result of his actual role whereas, say, cashiers who just see a fight through the window of their store because the shop is next to a rough pub.

    I will be appearing as "Galaxy1987 (job role). If it was something that happened outwith work I would not see it as in any way linked to my work and get on with it, but as I was doing my job that meant I had to be involved I feel it is work related.

    I really didn't think it was that hard to understand. He was working and in some way his job meant he had to get involved in whatever incident it was and therefore he is attending on behalf of his company.

    The vague nature isn't helping though. What is it you do job wise?

    I think that hard to understand or not, OP's response evades answering the real question, which is about whether the court attendance is of benefit to the employer.

    Its irrelivent whether it benefits the employer or not, there are plenty of occasions where an employee has to go to court on work time that does not benefit an employer.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked
