reclaiming bank charges after the bank said "no" to refunding me after court case

Hello peoples, I'm new to this so please bare with me.
I tried reclaiming my bank charges to the tune of just over £3,000, for the 6-year period leading up to the banks court hearings in 2009. At this time the bank (HSBC) wrote to me to inform me that my case for a refund was "on hold" until their case had passed through the courts.
After their court hearing was finalised about a year after the process had started, I sent another letter saying that I still wanted my refund and queried why there had been no reply from my bank since. They then sent me a reply letter saying that they were discarding my case as they had "won" their case with the courts.
I've since realised that it may still be possible to get my refund as this was just my bank's way of trying to throw me off the scent.
Can anyone help me with taking the next step, considering where I stand now, in order to re-apply for my reclaim?
I.e. should I send the bank another letter stating my intentions or, should I just take the matter to the ombudsmen and then on to court?
